Climate Savers Computing Initiative: Video Campaign OFFICIAL CONTEST RULES BY ENTERING THE CLIMATE SAVERS COMPUTING INITIATIVE: VIDEO CAMPAIGN, PARTICIPANTS AGREE TO BE UNCONDITIONALLY BOUND BY THESE OFFICIAL CONTEST RULES

1. THE CLIMATE SAVERS COMPUTING INITIATIVE: VIDEO CAMPAIGN IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
2. Sponsor The Climate Savers Computing Initiative: Video Campaign (the “Contest”) is sponsored by the Climate Savers Computing Initiative (“CSCI”), 3855 S.W. 153rd Drive, Beaverton, Oregon, 97006.
3. Overview Power Down for the Planet video campaign will bring together people from around the world to make a commitment to eco-friendly computing practices. The challenge is to develop original and creative videos that educate, entertain, and/or inform about the importance of energy efficient computing to the global environment. The contest is designed to build awareness about and inspire environmental change. It will inspire and highlight the environmental benefits of efficient computing in a new and exciting way. Prizes will be awarded to those who submit the best entries as determined by the judges at their entire discretion in accordance with these Official Rules.
For the purposes of this contest, a computer is defined in the following way by the EPA Energy Star Program Requirements for Computers:
Computer: A device which performs logical operations and processes data. Computers are composed of, at a minimum: (1) a central processing unit (CPU) to perform operations; (2) user input devices such as a keyboard, mouse, digitizer or game controller; and (3) a display screen to output information. For the purposes of this specification, computers include both stationary and portable units, including desktop computers, gaming consoles, integrated computers, notebook computers, tablet PCs, desktop-derived servers and workstations. Although computers must be capable of using input devices and displays, as noted in numbers 2 and 3 above, computer systems do not need to include these devices on shipment to meet this definition.
4. Eligibility Requirements NO PURCHASE NECESSARY. Higher Education Entrants: The Contest is open to individuals who are at least 18 years old and who are registered students at participating colleges and universities (“Student” or “You”). You may form teams comprised of up to 5 Students at your college or university (collectively, with Student, an “Entrant”). Entrants must be residents of Australia, Brazil, Canada, Czech Republic, France, Germany, Hong Kong, Israel, India, Ireland, Italy, Japan, Mexico, Netherlands, New Zealand, Poland, Russia, Spain, South Korea, Sweden, Taiwan, United Kingdom, or the fifty United States and the District of Columbia.
Non-Student/ Global Entrants: Non-student and global entrants must be 18 years or older and must be residents of Australia, Brazil, Canada, Czech Republic, France, Germany, Hong Kong, Israel, India, Ireland, Italy, Japan, Mexico, Netherlands, New Zealand, Poland, Russia, Spain, South Korea, Sweden, Taiwan, United Kingdom, or the fifty United States and the District of Columbia. Entrants may form teams comprised of up to 5 individuals.
Membership in the CSCI is not necessary to enter the Contest. Board of Director and Sponsor level members of the CSCI and their employees; employees of the CSCI; persons working directly on the Contest; Enviromedia and its employees; and immediate family members and persons living in the same household of each of the foregoing, are ineligible to enter the Contest. Residents of Iran, Sudan, Cuba, Syria, North Korea and Myanmar (Burma) are not eligible to participate. You must have access to the Internet and a valid e-mail address in order to enter the Contest.
5. Entry Procedure This contest begins at 12:01 A.M. United States Pacific Standard Time on March 2, 2009. All entries must be received electronically by the CSCI on or before 11:59 P.M. United States Pacific Standard Time, on April 17, 2009. Entries that are late or incomplete for any reason will be discarded and will not be judged. Individuals or teams can upload more than 1 Entry, but each individual or team is only eligible to receive prizes for one video.
To Enter: 1. Visit http://www.powerdownfortheplanet.org between 12:00:01a.m. PST on March 2, 2009 and 11:59:59pm PST on April 17, 2009. Click ‘Submit Your Video,' which will link to www.youtube.com/group/powerdown 2. If you are not an existing user of YouTube, you will be required to create a free user account. Registration on YouTube must be completed before a video can be submitted. When you register your YouTube account, you will be required to agree to the YouTube Terms of Use, located at http://www.youtube.com/t/terms, and the YouTube Privacy Policy, located at http://www.youtube.com/t/privacy. Entrants are solely responsible for creating an account and registration with YouTube prior to video submission. All video entries must be uploaded through the YouTube site. 3. On the contest page www.youtube.com/group/powerdown, click ‘Upload' in the upper right corner and follow the instructions to upload your submission. Individuals or teams can upload more than 1 video, but each individual or team is only eligible to receive prizes for one video. Submissions that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in the judging of this Contest. 4. Enter your Video Title and a description (optional) up to 150 words in the ‘Description' section. 5. After uploading your video to YouTube, click 'Join This Group.' You will receive the message "Welcome! You are now a member of this group." 6. Click on the 'Add Videos' link. Select the appropriate videos and click 'Add to Group." You will receive the message "Your videos have been submitted to this group." 7. Click 'Done' 8. Finish your video submission by completing the official entry form at: www.powerdownfortheplanet.org/submit-your-video/. Team leads and individuals submit the following information: name, contact information, country of residence, date of birth, the name of your video submission, your YouTube username, and the unique YouTube URL of your Submission. If you are entering a team submission, valid contact information for each team member is required. 9. All individuals and team members will receive a confirmation email within 1 week of your submission. Follow the steps to confirm your registration, thereby completing the registration process.
6. Submission Guidelines Entrants must develop and submit a creative video project. The Entry may not include images or voices of any person other than the Entrant(s). The Entry must be a solely original video project (i.e. solely created by the Entrant, Team, and/or Team member(s)) and must not infringe or violate the rights of any third parties, including, but not limited to copyrights, patents, trademarks, trade secrets, and rights of publicity/privacy. Only persons who contributed to the development or documentation of a project can be an Entrant for that particular project.
Maximum file size: 1 GB Max running time: no longer than 3 minutes Video formats: Files from digital cameras, camcorders, and phones in the following formats are acceptable: Windows Media Video (.avi), 3GP (cell phones), .AVI (windows), .MOV (mac), .MP4 (ipod/psp), .MPEG, .FLV (adobe flash), .SWF (shockwave flash), and .MKV (h.264). More information on acceptable file formats can be found on YouTube. But please avoid filming copyrighted material, such as logo-laden apparel.
All entries must be submitted in English or subtitled in English. Entries in any other language will not be considered. Entries that do not adhere to the instructions provided on the YouTube website and the terms and conditions of these Official Rules, or that are lewd, obscene, pornographic, or disparage the Sponsor or its Agents or are otherwise inappropriate will be disqualified at the Sponsor's sole discretion and removed from the website. Entries previously submitted in other contests or projects that have been previously commercialized are not eligible for entry in this Contest.
7. Judging Criteria All Entries will be judged by a panel between April 17, 2009 and May 4, 2009 based on the following equally weighted judging criteria: 1) creativity and 2) relevance to the Climate Savers Computing message of sustainable and efficient computing. In the event of a tie, the Entry among the tied Entries with the highest score in creativity will be declared the winner. All determinations by the Contest judges are final.
The contest's official judges are representatives from the Climate Savers Computing Board of Directors and Sponsor level companies. The judging process will be facilitated by Enviromedia, a social marketing company.
8. Prizes All participants are eligible to will the Grand Prize. To be eligible to win the Grand Student Prize, individuals and, if applicable, all team members must be enrolled at a participating University.
The Climate Savers Computing Grand Student Prize: $5,000 cash to the winning individual or team*, up to five 2009 Specialized Globe Vienna Deluxe 1 bikes powered by Specialized, and up to five licenses for Microsoft Expression Studio (one for each individual or team member)
The Climate Savers Computing Grand Prize: $5,000 to the winning individual or team* and one HP TouchSmart tx2z laptop for each individual or team member
* For team entries, the prizes will be awarded to the team lead. The team can then divide up the money as they see fit. For team members to each secure a prize, all team members must be listed at the time of registration.
All federal, state and local taxes and any other expenses associated with the prize are the sole responsibility of the winner. No prizes will be awarded to any participant who is not in compliance with these Official Rules, or with applicable law. No Entrant may win more than one prize, irrespective of the number of entries submitted.
9. Notification of Winners On or around May 4, 2009, finalists will be notified by email to the email address provided with the Entry. Delivery failure relating to that email will be exclusively at the Entrant's / Team's risk. Return of any prize / prize notification notice may result in disqualification and selection of an alternate winner. Finalists will be required to agree to keep their status confidential until winners are announced.
Winners will be announced May 4, 2009. As a condition of winning and claiming the prizes, winners must complete, sign and return an affidavit of eligibility, liability release, and publicity release, and, where applicable, such documentation necessary for CSCI to issue the winners IRS Form 1099s, within thirty calendar days of receipt of prize notification. Higher Education Entrant winners must also provide proof of enrollment at a participating college or university satisfactory to CSCI, within thirty calendar days of receipt of prize notification. If these documents are not completed and executed by a winner, and said completed and executed copies are not received by CSCI within thirty calendar days after they have been sent by CSCI to said winner, prizes will be forfeited and awarded to an alternative winner. If the notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. Should any winner make any false statements in any submission, the prize will be forfeited and the winner will be required to promptly return the prize to CSCI.
10. Internet If in CSCI’s sole judgment there is any suspected or actual evidence of tampering with any portion of the Contest, or if computer viruses, bugs, unauthorized intervention, fraud or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness or proper operation of this Contest, CSCI reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and or to void any entries submitted fraudulently or not in accordance with these Official Rules.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, CSCI RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEYS’ FEES) TO THE FULLEST EXTENT OF THE LAW.
11. Permission to use information about video submissions and winners As a condition of entering into this Contest, participants agree that CSCI may use, for all purposes and without compensation, all information or other submission of any kind submitted in the Contest. Winning participants agree that as a condition of accepting any prize, they will cooperate with CSCI in providing information regarding themselves and the winning video, including without limitation: the winner’s name and likeness(es); articles; and press releases. All such information may be used by CSCI for all purposes and without compensation.
Participants will not be required to disclose any personal financial information to enter the Contest.
12. Conditions As a condition of entering into this Contest, participants agree to the following: (a) Participants agree to be bound by these Official Contest Rules and the CSCI's determination of the winners, which shall be final. (b) Participants agree that all prizes are provided "AS IS" and to release and hold harmless CSCI and its employees, officers, directors, members, assigns, attorneys, representatives, and agents; Specialized Bicycle Components, Inc. and its employees, officers, directors, members, assigns, attorneys, representatives, and agents; Microsoft and its employees, officers, directors, members, assigns, attorneys, representatives, and agents; and Hewlett Packard Company and its employees, officers, directors, members, assigns, attorneys, representatives, and agents from all liability arising from or relating to the Contest or any prize won, including all liability arising from infringement of the intellectual property rights of any party. Participants agree to waive all rights to claim exemplary, punitive, incidental or consequential damages, or any other damages other than for actual out-of-pocket expenses, and that all causes of action arising out of or connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action. (c) Participants agree that this Contest is governed by the laws of the State of Oregon, United States, and that any dispute arising from this Contest will be governed by, and construed in accordance with, the laws of the State of Oregon, without reference to conflict of law principles, and the participants consent to personal jurisdiction in the state and federal courts of the State of Oregon and agree that such courts have exclusive jurisdiction over all such disputes. (d) CSCI reserves the right to cancel the Contest at any time without obligation or prior notice.
